OFWs Guide to Working in Taiwan

Taiwan is included in the list of top destination countries for most overseas Filipino workers or OFWs. Last year, it has more than 41,000 Filipinos holding overseas jobs as factory workers, caretakers and domestic helpers.

 

Like in any other foreign country, OFWs must strictly follow laws implemented by its government. Taiwan imposes the following for OFWs and other expat workers alike:

 

  1. The employer must obtain a work permit for the OFW upon entry to the country. The work permit should be carried by the OFW at all times, to be presented to Taiwanese authorities upon request.
  2. The OFW should present documents to the local police station, where his Alien Residence Certificate will be issued. The documents include letter of authorization from the Council of Labor Affairs and medical certificate with letter of authorization from the local health authorities.
  3. An OFW may stay only for one (1) year. But his employer can apply for the extension of employment for another year.
  4. There should be at least one rest day for every seven days of work, which do not include holidays. After one (1) year of work for the same employer, OFWs are entitled to seven (7) days special leave, beginning on the second year.
  5. OFWs wages should be agreed by both side and should be paid directly to the employee, which should not be lower than the minimum wage.
  6. OFWs are allowed to join labor unions but cannot be elected as director or supervisor position.
  7. If the OFWs employer has more than five (5) people, they are entitled to receive labor insurance and should pay the required contributions on a monthly basis.
  8. OFWs have to go through medical examination arranged by the employer at a hospital which is designated by the central health authority, within three (3) days upon arrival in Taiwan. 
  9. OFWs are not allowed to:
  • Perform any unauthorized work.
  • Refused a fixed-period medical examination during the period of employment.
  • Violate the Employment Service Law or regulations governing the authorization and administration of expat workers.
  • Violate any other laws of Taiwan.

     10. OFWs revocation of work permit and deportation will be based on violation of these laws.
