Breach of Contract in KSA: All You Need to Know

An overseas Filipino workers or OFW’s employment contract in Saudi Arabia should specify the basic salary, job title, the duties and responsibilities, the period of contract, and termination conditions.


OFWs should know when either they or their employer had made any action that is considered to be as violation of the contract.


The following are deemed breach of contract, in accordance with Saudi Labor law:


  • An OFW is employed under probation more than once by one employer.

  • An OFW’s contract was cancelled for no valid reason by the employer.

  • An OFW was ordered to perform a work different from the work agreed upon, unless there is a written agreement stating that it is done on a temporary basis.

  • An OFW is terminated because of illness or injuries obtain from his job, unless disability is stated in a medical certified issued by an accredited physician.

  • An OFW fails to fulfil his responsibility, disobey a legitimate order, or fails to comply rules impose to observe safety at work.

  • An OFW forged a document to obtain his job.

  • An OFW committed negligence which has the intention to cause material loss to the employer, provided it has an incident report to the authorities within 24-hour of its occurrence.

  • An OFW reveals commercial secrets of the work which he is engaged.

  • An OFW failed to finish his contract in the instated period.

  • An OFW is forced to continue his job even if the contract is finished, and no new contract between him and the employer is signed.

  • An OFW was maltreated by employer and disrespected by any word or deed that affects their dignity or religion.
