Caregivers Bound To Canada: Check Your Contract

  Jun 25, 2008

Overseas Filipino workers (OFWs) who aspire to work in Canada as a caregiver are advised by the Department of Labor and Employment (DOLE) to examine if the employment contracts offered by prospective Canadian employers complies with the recruitment conditions of the Philippine government.

The DOLE secretary, Marianito D. Roque reminded OFWs the need to ensure that necessary conditions are clearly stated in the contract before signing and accepting a job offer. Roque points out some of the benefits for OFWs that must be present and clearly stated in the employment contact. Examples are provisions for the medical coverage of OFWs' and air fares to and from Canada.

Hired OFWs bound to Canada are also not required to pay any placement fee.  Filipino caregivers are also assured that in the absence of a just reason, they cannot be terminated from work. If an OFW dies and the cause of death is work-related, the employer is obliged to shoulder the cost of repatriation.

The government agency issued the advisory as a response to the report by the Labor Attache of the Philippine Consular Office in Toronto, Frank Luna. Luna said that their office has been receiving calls from Canadian employers inquiring about the requirements they are required to comply in hiring OFWs.

The Labor secretary said that the reform package on hiring household service workers (HSW) also present the conditions required of foreign employers in deploying Filipino caregivers. Roque added that the policy reforms reflects  the requirements of Service Canada from employers contracting for the services of foreign temporary workers under the expanded labor market opinion (ELMO) in two Canadian provinces of British Columbia and Alberta.
